A mental health provider is agreeing to pay more than $3 million to resolve claims that tracking pixels on its website shared patient data with third parties without consent.

According to the settlement portal, LifeStance Health Group says it is agreeing to settle the class action lawsuit that alleged tracking pixels allowed Google and Facebook to access personally identifiable data, potentially violating HIPAA and Arizona’s Consumer Fraud Act.

The company has not admitted wrongdoing.

LifeStance Health Group is a mental health provider that offers therapy and psychiatric medication services at more than 600 locations around the United States. The firm offers outpatient care services and telemedicine.

Says the lawsuit,

“Simply put, if people do not trust that their sensitive private information will be kept private and secure, they may be less likely to seek medical treatment which can lead to much more serious health consequences down the road. In addition, protecting medical information and making sure it is kept confidential and not disclosed to any unauthorized entities is vitally necessary to maintain public trust in the healthcare system as a whole.”

The total payout of more than $3 million is split into a $1.2 million fund for patients who booked at least one session online during the time period of March 1st, 2020, and April 30th, 2023, and a $1.8 million fund for all other patients during the same timeframe.

Payments will be distributed on a pro rata basis after deductions.

Class members must submit a claim form by September 29th. The final approval hearing for the settlement is scheduled for October 16th.
